Terms of Service

1. Overview

Welcome to House of Nuré.

House of Nuré, also referred to in these Terms as “NURÉ”, “we”, “us” or “our”, operates this website and online store, including the related information, content, features, products and services collectively referred to as the “Services.”

Our online store is technically powered by Shopify, which enables us to provide our ecommerce Services.

These Terms of Service (“Terms”) apply to your access to and use of our website and to all orders and agreements entered into through our online store.

Please read these Terms carefully before using our website or placing an order.

By using our Services or placing an order, you agree to these Terms and to our applicable policies, including our Privacy Policy, Return & Refund Policy and Shipping Policy.

Nothing in these Terms limits or excludes any mandatory rights you may have as a consumer under applicable Dutch or European law.


2. Access and Accounts

You may use our website for personal and lawful purposes.

When placing an order, you confirm that you have the legal capacity to enter into the purchase agreement or, where legally required, have the consent of your legal representative.

When placing an order, we may request information including your name, email address, billing address, delivery address and payment information.

You are responsible for ensuring that the information you provide is accurate, current and complete.

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for activity carried out through your account.

You may not sell, transfer or otherwise make your account available to another person without our permission.


3. Our Products

NURÉ takes great care in the design, presentation and description of its products.

We aim to display colours, materials, proportions, finishes and details as accurately as reasonably possible. However, the appearance of products may vary slightly depending on screen settings, brightness, device configuration, lighting conditions and other technical factors.

Minor differences caused solely by screen representation do not automatically mean that a product is defective or non-conforming.

This does not affect your statutory rights where a product does not conform to what you could reasonably expect based on the purchase agreement.

We may update product descriptions, specifications, designs and our assortment or discontinue products where reasonably necessary.

Where appropriate, we may limit the quantity of certain products available per customer, order, household, region or country, including where reasonably necessary to protect the integrity of a collection or prevent unauthorised commercial resale.


4. Orders

When you place an order through our online store, you submit a request to purchase the selected products.

After placing an order, you will normally receive an electronic confirmation containing the details of your order.

We reserve the right, where legally permitted and where there is a reasonable basis to do so, to refuse or cancel an order.

Reasons may include:

  • incorrect or clearly erroneous pricing or product information;

  • suspected fraud or unauthorised payment activity;

  • misuse of our Services;

  • unusually large or suspicious order quantities;

  • suspected unauthorised commercial resale;

  • payment issues;

  • technical errors;

  • or unexpected unavailability of a product.

If we cancel an order for which payment has already been received, the applicable amount will be refunded using the original payment method unless otherwise agreed.

Please review your order carefully before completing your purchase.

Once an order has been processed or dispatched, we cannot guarantee that it can still be changed or cancelled.

Your statutory withdrawal rights and the rights set out in our Return & Refund Policy remain unaffected.

Purchases through our consumer online store are intended for personal use and not for unauthorised commercial resale.


5. Prices and Payment

Unless expressly stated otherwise, prices displayed to consumers include applicable VAT.

Any applicable shipping costs or other additional charges will be shown before you complete your purchase.

The price applicable to your order is the price displayed when the order is placed, except in the case of an obvious pricing or technical error.

We may change our prices at any time. Price changes will not affect orders that have already been accepted.

You are responsible for providing valid and accurate payment information.

By using a payment method, you confirm that you are authorised to use that payment method.

Payments are processed through the payment methods and payment service providers made available during checkout.


6. Shipping and Delivery

We aim to process and deliver orders within the estimated timeframes communicated during checkout or in our Shipping Policy.

Delivery times are estimates unless expressly stated otherwise and may be affected by carriers, periods of high demand, customs procedures, public holidays or circumstances outside our reasonable control.

For consumer orders, NURÉ remains responsible for the risk of loss or damage until the order has been received by you or by a third party designated by you, except where applicable law provides otherwise.

If you independently appoint a carrier that was not offered by NURÉ as a delivery option, the transfer of risk may be determined differently where permitted by law.

If an order is not delivered within the agreed or legally applicable timeframe, your statutory consumer rights remain unaffected.

You are responsible for providing a complete and accurate delivery address.

We cannot guarantee that an address can be changed once an order has entered processing or has been dispatched.

7. Returns, Refunds and Right of Withdrawal

Consumers purchasing online from NURÉ within the European Union generally have a statutory right to withdraw from an eligible purchase within 14 days of receiving the order, without giving a reason.

After notifying us of the withdrawal within the applicable period, the consumer generally has a further 14 days to return the relevant goods.

NURÉ additionally offers a voluntary extended return period of up to 30 days from receipt, subject to the conditions set out in our Return & Refund Policy.

The voluntary 30-day return period does not limit or replace your statutory withdrawal rights.

Any conditions relating to trying on garments, diminished value, return shipping costs, exclusions, refunds and the voluntary return period are described in our Return & Refund Policy.

Where statutory consumer law grants you additional rights, those rights remain fully applicable.


8. Product Conformity and Statutory Rights

NURÉ is responsible for supplying products that conform to the purchase agreement and meet applicable legal requirements.

If a product is defective, damaged or otherwise does not conform to what you were reasonably entitled to expect, you may have statutory rights to repair, replacement, price reduction, termination of the agreement or another appropriate remedy depending on the circumstances.

Nothing in these Terms or in any NURÉ policy excludes or limits statutory consumer rights that cannot legally be excluded or limited.


9. Intellectual Property

All content forming part of the NURÉ Services, including where applicable:

  • the NURÉ wordmark and figurative marks;

  • logos;

  • brand names;

  • product names;

  • garment designs;

  • graphic designs;

  • photography;

  • video;

  • written content;

  • illustrations;

  • packaging elements;

  • website design;

  • slogans;

  • visual identities;

  • and other creative materials,

is owned by House of Nuré, its licensors or other applicable rights holders, unless stated otherwise.

Such materials may be protected by copyright, trademark rights, design rights and other applicable intellectual property laws.

You may use NURÉ content only for personal and non-commercial purposes unless we expressly permit otherwise.

Without prior written permission, you may not copy, reproduce, modify, distribute, sell, publish, commercially exploit or otherwise use protected NURÉ materials for the development, promotion or commercial benefit of another product, brand, service or business.

The names NURÉ and House of Nuré, our logos, designs and other brand elements may not be used without permission to the extent they are protected by applicable intellectual property rights.

All rights not expressly granted are reserved.


10. Third-Party Services

Our Services may include functionality provided by third parties, including payment providers, shipping carriers, analytics providers and technical service providers such as Shopify.

Additional terms and privacy policies of those third parties may apply to their own services.

Where an issue is exclusively attributable to a third-party service outside our reasonable control, our responsibility may be limited to the extent permitted by law.

This does not affect any rights you may have directly against NURÉ under mandatory consumer law.


11. Links to Third-Party Websites

Our website may contain links or references to third-party websites or services.

We do not necessarily control the content, availability, security or practices of those third-party websites.

When visiting an external website, we recommend reviewing the applicable terms and privacy policy of that party.

NURÉ is not responsible for transactions entered into directly between you and an unrelated third party, except where applicable law provides otherwise.


12. Privacy

We process personal data in accordance with our Privacy Policy and applicable data protection law.

Because our online store is powered by Shopify, Shopify may process certain personal information where necessary to provide, secure and improve the technical ecommerce Services.

Personal information may also be processed by payment providers, shipping carriers and other service providers where necessary to fulfil an order or provide our Services.

13. Feedback and Submissions

If you voluntarily provide NURÉ with feedback, suggestions, ideas, reviews or other content, you allow us to use that content for legitimate business, service and communication purposes to the extent permitted by applicable law.

You confirm that content submitted by you does not infringe the rights of third parties and is not unlawful, misleading, defamatory or otherwise harmful.

You remain responsible for content that you submit.

Any personal information contained in such communications will be handled in accordance with our Privacy Policy.


14. Errors and Inaccuracies

Despite our efforts to keep our Services accurate, our website may occasionally contain typographical errors, technical errors, incorrect stock information or other inaccuracies.

We may correct such errors when they are discovered.

If an error materially affects an order, we may contact you to clarify the situation.

In the event of an obvious pricing error or other clear mistake, we reserve the right, to the extent permitted by law, not to accept or to cancel the affected order.

If payment has already been received for an order cancelled for this reason, the applicable amount will be refunded.


15. Prohibited Use

You may not use our website or Services:

  • for unlawful or fraudulent purposes;

  • to infringe the rights of NURÉ or any third party;

  • to distribute malware, viruses or harmful code;

  • to circumvent security measures or access restrictions;

  • to collect personal information of others without authorisation;

  • to impersonate another person or organisation;

  • for spam, phishing or other deceptive activities;

  • to intentionally interfere with our website or technical infrastructure;

  • to scrape, copy, collect or commercially exploit substantial amounts of content or data without authorisation;

  • to circumvent technical measures designed to protect our Services;

  • or for any other activity that is unlawful or may materially damage our Services, customers or business.

Where legally permitted, we may restrict access to our Services or suspend accounts where we reasonably determine that these Terms have been seriously violated.


16. Suspension and Termination

We may suspend or terminate access to certain Services or an account if you seriously breach these Terms, engage in fraud, misuse our systems or intentionally cause harm to our business, Services or other users.

Such suspension or termination does not affect statutory rights or obligations arising from existing orders or agreements.

Provisions which by their nature are intended to survive termination will remain in effect.


17. Availability of the Services

We aim to keep our website secure, accurate and available.

However, we cannot guarantee that the website will operate completely uninterrupted or error-free at all times.

Maintenance, technical failures, external services and circumstances outside our reasonable control may temporarily affect availability.

The temporary unavailability of our website does not affect statutory rights relating to products already purchased.


18. Liability

NURÉ remains liable where liability arises under mandatory applicable law.

To the extent permitted by law, NURÉ will not be liable for indirect or unforeseeable losses that were not reasonably foreseeable when the relevant agreement was entered into and that do not result from a breach attributable to NURÉ.

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

Nothing in these Terms excludes or limits your mandatory statutory consumer rights.


19. Severability

If any provision of these Terms is found to be wholly or partially invalid, unlawful or unenforceable, this will not affect the validity of the remaining provisions.

Where possible, the affected provision will be interpreted or replaced in a manner that most closely reflects its intended purpose while complying with applicable law.


20. Entire Agreement

These Terms, together with our:

  • Privacy Policy;

  • Return & Refund Policy;

  • Shipping Policy;

  • and any other policies or specific terms made available before purchase,

form the terms applicable to the use of our Services and purchases made through our online store.

If specific terms relating to a particular product or service conflict with these general Terms, the more specific terms will apply to the extent permitted by law and provided they were clearly communicated before purchase.


21. Transfer

You may not transfer your rights or obligations under an agreement with NURÉ where doing so would materially affect our rights or ability to perform the agreement, unless we agree otherwise.

We may transfer our business or rights and obligations in connection with a reorganisation, merger, acquisition or transfer of business, provided that this does not reduce your mandatory statutory consumer rights.


22. Governing Law and Disputes

These Terms and agreements entered into with House of Nuré are governed by Dutch law.

If you are a consumer residing in another country, this choice of law does not deprive you of mandatory consumer protections that apply to you under the law of your country of habitual residence.

Any dispute will be submitted to a court with jurisdiction under applicable law.
